Real Estate Transaction Screen Assessment

A Transaction Screen Assessment (TSA) is performed according to guidelines set forth in ASTM E1528-06 and is intended primarily as a sound and economical method of identifying potential environmental concerns related to a property. Designed to be performed voluntarily, the process fulfills a limited amount of environmental due diligence and is no longer recognized as "All Appropriate Inquiry" under 40 C.F.R. Part 312. Therefore, the user does not receive protection under the "Comprehensive Environmental Response Compensation and Liability Act Landowner Liability Protections" (CERCLA LLPs) when the TSA method is used. At the very least, a TSA will confirm to a certain degree the user's inclination that the subject property is and has been free of hazardous material or petroleum contamination; at the other end of the spectrum the TSA report reveals information previously unknown to the user and becomes the initial study to a more in-depth investigation of a property.

The degree to which a TSA can confirm the absence of environmental concern related to a property is limited, due in part to the fact that anyone can perform a TSA.
